Bryan L. Walker is a patent attorney in the Intellectual Property & Technology practice group. Mr. Walker prepares patent applications and advises clients on patent prosecution strategies and likelihoods of success, invention patentability, and analysis of prior art search results. He is experienced in conducting interviews with inventors, as well as with USPTO Patent Examiners. He has drafted Office Action Responses addressing restrictions, double-patenting, new matter, objections, 35 USC §§ 101, 103, 102 and 112. Mr. Walker has also prosecuted trademark applications, drafted validity copyright infringement opinions, and co-developed an IP policy manual for a client.
Mr. Walker’s background includes working as a patent examiner for nearly three years at the U.S. Patent & Trademark Office. At the USPTO, he issued hundreds of Office Actions for database system patent applications, received top ratings for award-winning performance and attained the senior level of GS-13.
Before law school, Mr. Walker worked at Motorola on iDEN telecommunications technology as a graduate research assistant while he was a Master’s Degree candidate. He also worked with a wide array of technologies as system administrator for a world-class resort, The Breakers Palm Beach. He began his career as a LAMP software developer in the Department of Biomedical Science at Florida Atlantic University. In this position, he coordinated distance-learning technology for the department’s inaugural medical school class in partnership with the University of Miami School of Medicine.
Mr. Walker has authored and co-authored articles for The Legal Intelligencer and the Forum for International Trade Training. Topics have included international design patent applications, patent application process analytics, protecting IP rights in international markets, considerations for when to disclose patent prior art, understanding and avoiding RCE limbo, and First Action Allowance of patent applications.
He received his J.D. from Washburn University School of Law, where he represented indigent clients in the community as a licensed law clinic intern. He was selected to be a research assistant on his professor’s West treatise, Modern Constitutional Law, Third Edition. As a summer law clerk, he provided litigation support for the largest social services agency in Kansas. He also served as Vice President of the Intellectual Property Society. Additionally, Mr. Walker earned an M.S. and a B.S. in Computer Science at Florida Atlantic University.
Mr. Walker is a senior member of the Institute of Electrical and Electronics Engineers. He is a member of the American, District of Columbia, and Erie County Bar Associations, and the American Intellectual Property Law Association.
Mr. Walker is admitted to practice in the District of Columbia; Kansas; U.S. District Courts for the Western District of Pennsylvania, District of Kansas, and Western District of Missouri; U.S. Court of Appeals, Federal Circuit; U.S. Supreme Court; and the U.S. Patent and Trademark Office.
