Cecilly C. Shelton

Biography

Cecilly C. Shelton is an associate in the firm’s Litigation Department. She has handled premises liability matters, food safety matters, surety bond claims, breach of contract cases, collection suits and levy, garnishments, loan repurchase disputes, and arbitration award confirmation, among a host of other general litigation matters. She regularly conducts research and writes litigation briefs both for state and federal courts.

She has represented Fortune 500 Corporations in the defense of liability claims and the recovery of contractual damages. She has overseen actions associated with violations of RESPA, TILA, and loan servicing, including property insurance claims. She has particular
expertise in title litigation, representing title insurers, and bringing actions for reformation of title, establishment of lost records, and injunctive or other equitable relief and utilizing the litigation process where necessary to preserve or enforce real and personal property interests.

Ms. Shelton has also assisted in residential and commercial mortgage foreclosures in multiple jurisdictions, including Georgia, Tennessee, Florida, Massachusetts, Colorado, North Carolina, New York, Iowa and Wisconsin; trustee services; debt acceleration; judicial recovery of collateral; and personal property/automobile replevin; evictions; garnishments; bankruptcy stay relief; and proofs of claim filings.

For financial institutions, Ms. Shelton provides case assessment, multi-jurisdictional legal opinions, and facilitates the surrender of
collateral property. Her experience also includes closing transactions—conducting closings of residential and small commercial property loans, as well as business loans secured by personal and intellectual property. She provides attorney opinion letters, title review, and contract review, drafting and negotiation (i.e. land purchase contracts, assumptions, subordination agreements, forbearance agreements, asset assignments, deed preparation, easements, loan modifications, homeowner’s association covenants and mobile/manufactured home title retirement).

Ms. Shelton earned a J.D. at The University of Texas School of Law and a B.A. in Business and a B.A. in Political Science at Southwestern University. Her professional memberships include the State Bar of Georgia, where she is a member of the Real Property Law Section and the Minorities in the Profession Committee, and is also a member of the State Bar of Tennessee. Ms. Shelton is admitted to practice in Georgia, Tennessee, U.S. District Court for the Northern and Middle Districts of Georgia, and the U.S. Court of Appeals.
