Kristin Petersen Baldrica’s practice encompasses intellectual property and business law, with a focus on trademark and copyright law, in transactions and in litigation (federal and state).
Ms. Petersen Baldrica has represented and advised clients on a wide range of trademark and copyright infringement issues, including the defense of a well-known fashion designer against trademark infringement, dilution, and disparagement claims brought by a religious group. Previous matters have included infringement claims involving branding on athletic shoes, unauthorized online book distribution, alleged copying of websites and logos, two-dimensional artwork by a start-up company copied by a major retailer, royalties for satellite streaming of pre-1972 music, use of a university’s marks on blog featuring criticism of the institution, infringement of three-dimensional artwork produced in China, and overseas production of counterfeit remote-controlled helicopters. Representative published matters include Riedell Shoes, Inc. v. Adidas AG, 2011 U.S. Dist. Lexis 52355 (securing home-state jurisdiction in trademark infringement action under the first-to-file rule).
Ms. Petersen Baldrica also has extensive experience with trademark clearance searches and registration filings with the USPTO, as well as representing clients in opposition proceedings before the USPTO Trademark Trial and Appeal Board.
In business litigation, Ms. Petersen Baldrica has extensive experience with actions involving shareholder disputes in close corporations and claims involving actions for dissolution, breach of contract, unfair competition, and trade secret misappropriation. Recently, she served as second chair for a jury trial in Los Angeles Superior Court in a professional malpractice and breach of fiduciary duty case. She also was a member of the trial team that defeated a multi-million dollar trafficking class action claim in a highly-publicized jury trial in the United States District Court, Central District of California.
On the transactional side, Ms. Petersen Baldrica has advised business from major corporations to entrepreneurs in drafting and reviewing contracts and forming business entities. Ms. Petersen Baldrica has served as short-term in-house counsel on secondments to two international publicly traded companies in compliance and contracting, providing her with insight into the objectives, strategies, and risk management protocols of major corporations. In these roles, she has drafted and revised licensing and nondisclosure/confidentiality agreements, as well as agreements covering supplier, warehousing, retailing, services, supply agreements, warehousing, and business relationships for joint ventures. She has also managed the legal compliance review process for acquisitions for one of the world’s largest consulting and technology corporations.
A cum laude graduate of the University of Minnesota Law School, Ms. Petersen Baldrica was elected Editor-in-Chief of the Minnesota Journal of International Law and served in the Law School’s pro bono public interest and domestic violence law clinics. Ms. Petersen Baldrica received a B.A., summa cum laude from Boston College. Ms. Petersen Baldrica is a member of the Pasadena Bar Association, American Bar Association and Los Angeles County Bar Association.
Ms. Petersen Baldrica is admitted to practice in California, Minnesota, the U.S. District Court for the District of Minnesota, and the U.S. District Court for the Central District of California.
