Stephen J. Vitola has more than ten years of experience working in the Intellectual Property (IP) and Technology sectors at top-tier law firms and corporations. In his work with a global chemical company, diagnostic laboratory, and with high tech businesses, Mr. Vitola has managed worldwide IP matters and the global strategic development of patent and trademark portfolios. In addition, he has interacted with scientists and management to identify intellectual property, prosecute patents and trademarks worldwide, protect trade secrets and copyrights, and provide opinions regarding product launches and clearances, IP monetization, patentability, validity, patent landscape, and dispute resolution for companies in the medical device, chemical, pharmaceutical, biotechnology, automotive, computer hardware and software, and consumer products fields.
Mr. Vitola has managed, reviewed, negotiated, and drafted a multitude of agreements, including confidentiality agreements, IP agreements, licenses, technology agreements, clinical trial and R&D agreements, joint venture agreements, and other corporate transactional matters. He has also advised senior management on commercial contracts, domain names, compliance of advertising and marketing materials, and mitigation of corporate risk through implementation of enterprise policies. For example, Mr. Vitola has drafted and implemented enterprise policies and procedures relating to information technology, social media, information preservation (including use of personal devices in the workplace) and intellectual property, as well as privacy policies and website terms of use.
He is experienced in working with and drafting software licensing agreements and has provided legal services relating to mobile operating systems and applications, delivery of digital media, cloud computing, Software as a Service (SaaS), and alternative energy.
Mr. Vitola is also experienced in drafting employee agreements assigning IP rights and protecting trade secrets and other confidential information in the U.S. and in many other countries, utilizing his knowledge of the general framework of foreign laws pertaining to IP rights and working with foreign counsel, as needed.
Mr. Vitola earned his Juris Doctor (J.D.) degree at the Boston University School of Law, and a Bachelor of Science (B.S.) degree in Molecular and Cell Biology at the University of Connecticut. He is licensed to practice in New York and Connecticut and before the United States Patent and Trademark Office.
