Steven Gerber and Ola Nunez Featured in DRI’s For the Defense

Steven Gerber and Ola Nunez were featured in DRI’s For the Defense, when they won a motion for involuntary dismissal with prejudice in state court at the close of plaintiff’s evidence after two and a half days at trial. The court ruled that the plaintiff, a former employee of the defendant emergency medical services provider, had failed to sustain his burden of establishing the prima facie elements of his claims of marital status and gender discrimination under the New Jersey Law Against Discrimination. The court’s lengthy written decision rested largely on the cross-examination of the plaintiff’s witnesses. Mr. Gerber and Ms. Nunez had also previously successfully moved for the dismissal of the plaintiff’s common law wrongful discharge claim, as well as his claim based on the state constitution.
