Biography
Jonathan D. Goins is a partner with expertise in the intellectual property practice areas of trademarks, copyrights and trade secrets. Mr. Goins has represented Fortune 500, mid-sized and start‐up companies in litigating IP disputes; managing trademark and copyright clearance, prosecution and enforcement matters; resolving Internet and social media issues related to trademarks, domain names and copyrights; and negotiating a wide variety of transactions involving IP rights.
With major law firm experience, Mr. Goins has advised on matters involving Lanham Act claims (trademark infringement, dilution, false advertising and unfair competition), cybersquatting, Internet libel and gripe sites, misappropriation of trade secrets, copyright infringement, breach of contract and fraud. His trademark practice has covered all aspects of portfolio management (including global brand marketing strategy, search opinions, advertising clearance, prosecution and maintenance) and enforcement via franchise brand use and distribution compliance, cease and desist letters, negotiated licenses and settlements, and proceedings before the U.S. Trademark Trial & Appeal Board and the World Intellectual Property Organization’s Arbitration & Mediation/UDRP Center. In efforts to mitigate litigious risks, Mr. Goins has prepared confidentiality non-disclosure agreements, non-solicitation and non-compete agreements, trade secrets’ policies, IP due diligence in corporate mergers and acquisitions, and copyright “works-for-hire” agreements. He has also negotiated advertising sponsorship and promotional rights agreements, and other contracts involving exclusivity, ownership and use of IP rights.
Mr. Goins is a “go-to” IP attorney for the media, sports and entertainment industry, having advised over two dozen high-profile management and production agencies, professional athletes, sports agents, best-selling authors, television commentators, and artists in “general counsel” matters involving trademark and copyright clearance, restrictive covenants, rights of privacy/publicity, defamation/false light, Internet libel, arbitration of sports contract disputes, and negotiated agreements for talent and production in music, tv and film.
Mr. Goins is a frequent speaker on various topics regarding intellectual property, and lectures on copyright and trademark law as an Adjunct Professor at Atlanta’s John Marshall Law School. Nominated by in-house counsel, Mr. Goins is a member of the New York-based Council on Litigation Management Alliance. He is the firm’s designee for the International Trademark Association (Internet Committee, 2012-14 term). Mr. Goins was also nominated into the Atlanta Intellectual Property American Inn of Court. He has been selected for inclusion in the 2013 Georgia Rising Star℠ list by Super Lawyers®, a 2012 Nation’s Best Advocates: 40 Lawyers Under 40 by the National Bar Association, Atlanta Business Chronicle’s Top 40 Under 40 Up & Comers (2010), Outstanding Atlanta (2008) and State Bar of Georgia’s Leadership Academy (2008). He has served as Chair of the State Bar of Georgia’s IP Committee (2009-2011) and as board member for organizations such as the Boy Scouts of America-Atlanta Area Council’s Whitney M. Young Annual Banquet (2011) and the State Bar of Georgia’s Diversity Program (2007-2012). Mr. Goins was a judicial law clerk to the Honorable Inez Smith Reid of the D.C. Court of Appeals.
Mr. Goins earned a B.A. at the University of Louisville and a J.D. at Howard University School of Law. He was a judicial law clerk to the Honorable Inez Smith Reid of the D.C. Court of Appeals. He is licensed to practice in Georgia, the District of Columbia and the U.S. Court of Appeals (Federal Circuit).
