Biography
Ramsey Kazem is an experienced litigator with a practice focusing on construction law, government contracts, contract formation, and commercial litigation. He represents owners, general contractors, and subcontractors in various contract disputes involving both public and private construction projects. These disputes address many issues, including contract interpretation, delays, contract changes, differing site conditions, wrongful termination, defective work and payment.
Mr. Kazem also has experience handling matters involving the Federal Acquisition Regulations, the Foreign Corrupt Practices Act, and the Contract Disputes Act. He assists clients in negotiating and drafting construction contracts and partnering agreements (including teaming, joint venture, and consulting agreements). Mr. Kazem also counsels clients on risk management, project administration, claim preparation, and project documentation, and resolves claims through negotiation and mediation. He has served as lead and co-counsel in arbitration, trial court proceedings, and before the Armed Services Board of Contract Appeals.
Mr. Kazem’s representative experience includes the following matters. He represented a contractor in arbitration for claims arising out of a high-rise condominium project in Florida. The contractor recovered on its claims for wrongful termination, scope changes, delay, and attorneys’ fees. The contractor also defeated owner’s $100MM claim for delay damages and cost to complete. In addition, Mr. Kazem represented the owner of a retirement community seeking recovery for contractor’s incomplete and defective work and defending against contractor’s claims for interference with work, delay, and payment. An arbitration panel found in favor of owner. He also represented a contractor before the Armed Services Board of Contract Appeals successfully overturning the Army Corps of Engineers’ default termination of the contractor’s contract.
In addition to his practice, Mr. Kazem has presented at seminars, including “What to Do When Construction Projects Go Bad” and “The Fundamentals of Construction Contracts: Understanding the Issues in Georgia” for Lorman Educational Seminars and “Construction Dispute and Claim Avoidance” for the Associated General Contractors of America, Georgia Branch. Mr. Kazem has been included on the Georgia Rising Star℠ list in 2005, 2006 and 2009 – 2013 by Atlanta Magazine.
Mr. Kazem is originally from Nijmegen, the Netherlands. He received his B.S., magna cum laude, in Finance with a concentration in International Business from Fairleigh Dickinson University. After college, he attended law school and business school at Emory University, where he earned his J.D. and M.B.A. While in law school, he served as a Managing Editor of the Bankruptcy Developments Journal and was a member of the Emory Moot Court Special Teams (securities team). Mr. Kazem gained experience as a summer clerk for the U.S. Attorney’s Office, Northern District of Georgia.
Mr. Kazem is admitted to practice in the State of Georgia, U.S. District Court for the Northern District of Georgia, Georgia Supreme Court, Georgia U.S. Court of Appeals, and the U.S. Court of Federal Claims. He is conversant in Dutch.
