Cecilly C. Clark has overseen the conduct of residential mortgage foreclosures in Georgia, Tennessee, Florida, Massachusetts, Colorado, and North Carolina, performing non-judicial foreclosures and sales of secured assets for residential mortgage loans and lines of credit, judicial foreclosures, trustee services, debt acceleration, judicial recovery of collateral, and personal property/automobile replevin.
Ms. Clark is well versed in title curative services, including resolving title issues impeding sales and closings, researching and obtaining curative documents, and utilizing the litigation process where necessary to achieve a quick conveyance in order to reduce client losses. Her services also include opinion letters, contract review, drafting and negotiation, loss mitigation, subordination agreements, forbearance agreements, asset assignments, deed preparation, easements, loan modifications, and facilitating the surrender of real property to creditors.
Ms. Clark has represented Fortune 500 companies and various creditors in litigation, including plaintiff’s and defense actions, liability claims, title insurance claims, contractual damages, reformation of title, injunctive relief claims, equitable relief, eviction/dispossessory actions, garnishments, bankruptcy stay relief, and proofs of claim filings. She has also served an advisory role to financial institutions, providing case assessment, multi-jurisdictional legal opinions, title review, title clearance, and certification of title priority rights for secured instruments, and mobile/ manufactured home title retirement.
Her closing and REO (Real Estate Owned) experience includes the conduct of closing mortgage and cash transactions, drafting and reviewing lease agreements, listing agreements, homeowner's association covenants, purchase contracts and related documents; thereby assisting financial institutions with the loan transactions and the preparation, disposition, and sale of its REO assets.
Ms. Clark earned a J.D. at The University of Texas School of Law and a B.A. in Business and Political Science at Southwestern University. Her professional memberships include the State Bar of Georgia, where she is a member of the Real Property Law Section and the Minorities in the Profession Committee, and the State Bar of Tennessee.
